fa چالش‌های قانونی صدور مجوزهای دولتی فعالیت‌های بهداشتی و درمانی در نظام حقوقی ایران؛ تحلیلی بر پراکندگی قوانین، تعدد نهادهای ناظر، تورم مجوزها و خلاءهای قانونی Legal Challenges in Issuing Governmental Licenses for Health Activities in the Iranian Legal System: An Analysis of Legislative Dispersion, Multiplicity of Supervisory Institutions, License Proliferation, and Legal Gaps عمومى General مروری Review مقدمه: نظام صدور مجوزهای دولتی بهداشتی و درمانی به عنوان یکی از ابزارهای کلیدی تولیت سلامت، نقش اساسی در سلامت عمومی ایفا می‌کند. با این حال، چارچوب حقوقی حاکم بر این مجوزها در نظام حقوقی ایران با چالش‌های ساختاری مواجه است که می‌تواند کارآمدی نظام سلامت، امنیت حقوقی ذی‌نفعان و دسترسی به خدمات را به چالش بکشد. روش کار: این پژوهش از نوع حقوقی–تحلیلی با رویکرد توصیفی–تحلیلی است. داده‌ها از طریق تحلیل اسنادی قوانین معتبر و لازم‌الاجرا (از سامانه ملی قوانین و مقررات) گردآوری شد. ابتدا قوانین مرتبط شناسایی و تنقیح گردید، سپس با روش تحلیل ساختاری، روابط میان قواعد، نهادها و مجوزها بررسی شد. در مواردی، از مطالعه تطبیقی با قانون جامع سلامت فرانسه برای شناسایی خلاءها استفاده گردید. یافته‌ها: یافته‌های پژوهش حاکی از وجود چالش‌های ساختاری در نظام حقوقی مجوزهای بهداشتی و درمانی است. احکام قانونی مرتبط به‌صورت پراکنده در قوانین متعدد توزیع شده، نهادهای متنوعی در صدور و نظارت بر مجوزها دخیل هستند، تعدد و تورم مجوزها مشاهده می‌شود، ابهام و تعارض هنجاری در رابطه میان مجوزهای عام و خاص وجود دارد و خلاءهای قانونی در حوزه‌هایی مانند مجوز سکوی توزیع اینترنتی دارو، مشهود است. این چالش‌ها می‌توانند بر یکدیگر و نهایتا بر کارآمدی تولیت سلامت اثر منفی بگذارد. نتیجه‌گیری: چالش‌های شناسایی‌شده ماهیتی ساختاری دارد و نیازمند بازاندیشی است. پیشنهاد می‌شود با تدوین و تصویب قانون جامع سلامت، انسجام تقنینی افزایش یابد، صلاحیت نهادها شفاف شود و مجوزها بازبینی گردد تا کارآمدی نظام مجوزدهی ارتقا یابد. Introduction: The system of issuing governmental licenses for health activities serves as one of the key instruments of health stewardship, playing a fundamental role in safeguarding public health. However, the legal framework governing these licenses in the Iranian legal system faces structural challenges that can undermine the efficiency of the health system, legal security for stakeholders, and access to services. Methods: This study is a legal-analytical research with a descriptive-analytical approach. Data were collected through documentary analysis of valid and enforceable laws (from the National Laws and Regulations Portal). Relevant laws were first identified and refined, followed by structural analysis of relationships among rules, institutions, and licenses. In certain cases, a comparative study with the French Health Code was employed to identify legal gaps. Results: The research findings indicate the presence of structural challenges in the legal system of health and medical licenses. Related legal provisions are scattered across multiple laws, various institutions are involved in issuance and oversight, proliferation and inflation of licenses are observed, normative ambiguity and conflicts exist in the relationship between general and specific licenses, and legal gaps are evident in areas such as licensing for online drug distribution platforms. These challenges can interact with one another and reduce the effectiveness of health stewardship. Conclusion: The identified challenges are structural in nature and require fundamental reconsideration.
